Agreement to these Terms
These Terms of Service form a binding agreement between you and SOFTWARE GRID LLC, the operator of Wan 3.0. By accessing the website, creating an account, purchasing credits or a subscription when available, or using the Service, you agree to these Terms and our Privacy Policy.
If you use the Service for an organization, you represent that you have authority to bind that organization. You and the organization are both responsible for compliance with these Terms.
Eligibility and accounts
You must be at least 18 years old or the age of legal majority where you live and legally able to enter into this agreement. You must provide accurate account information, protect access to your account, and accept responsibility for activity performed through it.
Notify support@wan3.video promptly if you suspect unauthorized access. You may not create or coordinate multiple accounts to repeatedly obtain signup credits, evade limits or enforcement, or otherwise manipulate the Service.
The AI Service
Wan 3.0 lets you submit text, images, videos, and other materials as inputs and receive AI-generated or AI-edited video results as outputs. The Service may rely on third-party AI models, hosting, storage, moderation, payment, and other infrastructure.
AI generation is probabilistic. Outputs may be inaccurate, incomplete, unexpected, unsuitable, or similar to content generated for other users. We do not guarantee that an Output will be unique, factually correct, legally protectable, or fit for a particular purpose. Review every Output before using or publishing it.
Inputs, Outputs, and intellectual property
You retain any rights you already hold in prompts, files, images, videos, and other materials you submit as Inputs. You represent that you have all rights, licenses, permissions, and consents needed for us to process each Input and for your requested use.
You grant SOFTWARE GRID LLC a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, modify, and process Inputs and Outputs only as reasonably necessary to operate, secure, moderate, support, and provide the Service, comply with law, and enforce these Terms.
Subject to applicable law and third-party rights, you may use Outputs for personal or commercial purposes. SOFTWARE GRID LLC does not claim ownership of an Output solely because it was generated through the Service. This does not guarantee copyright protection, exclusivity, or freedom from third-party rights. You are responsible for clearing your intended use. SOFTWARE GRID LLC and its licensors retain all rights in the Service itself.
Acceptable use
You may not use the Service to violate law or another person's rights; create or distribute child sexual abuse material, non-consensual intimate imagery, unlawful exploitation, credible threats, or targeted harassment; infringe intellectual property, privacy, publicity, or data-protection rights; impersonate or deceptively misrepresent a person or content source; distribute malware; facilitate fraud; or make unlawful high-impact decisions about another person.
You may not bypass safeguards, moderation, billing, usage limits, or access controls; reverse engineer or extract models except where law expressly permits it; overload, scrape, resell, or automate the Service without authorization; manipulate payments or credits; or abuse free benefits through multiple accounts. We may moderate Inputs, block requests, remove content, and restrict accounts to protect users, the Service, and third parties.
Privacy
Our Privacy Policy explains how SOFTWARE GRID LLC collects, uses, shares, retains, and protects personal information. Do not submit personal, confidential, biometric, or regulated information unless you have a lawful basis and understand how the Service will process it.
Credits, subscriptions, and billing
New membership-pass and credit-pack purchases may be paused during maintenance. When enabled, prices, pass duration, included credits, supported payment methods, and applicable fees will be shown on the Pricing page or at checkout, and new payments will be processed by Anyway.
Pre-existing Stripe subscriptions may continue renewing for their selected monthly or annual period until canceled. Annual subscriptions charge one year in advance and grant 12 months of credits; monthly subscriptions grant credits after each successful invoice. No new recurring subscription is created through Anyway's current pass checkout.
New 30-day and 365-day membership passes are one-time purchases and do not renew automatically. During the migration, pre-existing Stripe subscriptions can still be managed through the Stripe Customer Portal; cancellation normally takes effect at the end of the current paid period and does not automatically reverse charges already paid for that period.
One-time credit packs do not require a subscription. Under current Service rules, purchased pack balances and subscription credits already granted do not expire. Credits are a limited Service entitlement, not money or stored value, and cannot be transferred, resold, withdrawn, or redeemed for cash. Free or promotional credits may be withheld, frozen, or revoked when obtained or used through error, fraud, coordinated account abuse, or another violation of these Terms.
Failed generations and refunds
The Service reserves the displayed number of credits when a generation starts. If the provider job fails, is canceled by the system, or completes without a usable video result, the reserved credits are automatically returned to your Wan 3.0 balance once. Duplicate callbacks do not create duplicate returns.
A credit return restores Service credits and is not a cash, card, or bank refund. Because AI results are probabilistic, dissatisfaction with the style, composition, accuracy, or usefulness of a successfully completed Output does not by itself make the generation failed or automatically qualify it for a credit return.
Except for automatic failed-generation credit returns, refunds required by law, or an express written offer shown at checkout, payments are generally final. Contact support@wan3.video about duplicate charges, missing paid credits, or billing errors. Automatic returns do not create a right to restore credits to an account suspended or terminated for fraud or abuse.
Availability and storage
We may maintain, update, modify, limit, suspend, or discontinue all or part of the Service. Availability can be affected by maintenance, provider capacity, network failures, security events, legal requirements, or events outside our reasonable control.
A plan that includes permanent result storage is intended to keep completed results available without a scheduled expiration while the account remains in good standing and the Service continues. It is not an archival or backup guarantee. Download and securely retain any Output important to you.
Suspension and termination
You may stop using the Service at any time. Stopping use does not cancel an active subscription; subscriptions must be canceled through the available billing controls.
We may suspend, restrict, or terminate access if you breach these Terms, create security or legal risk, fail to pay amounts due, misuse credits, engage in fraud or abuse, or if continued operation is no longer reasonably possible. Where reasonable and legally permitted, we will provide notice.
After termination, your account, Inputs, Outputs, and remaining credits may become inaccessible and may later be deleted under our retention practices. Termination does not create a right to cash redemption of credits or a refund except where required by law. Provisions that by their nature should survive termination remain effective.
Disclaimers
To the maximum extent permitted by law, the Service and all Outputs are provided AS IS and AS AVAILABLE. SOFTWARE GRID LLC disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
Outputs are not professional, legal, medical, financial, safety, or other expert advice. You are responsible for deciding whether and how to use an Output and for obtaining appropriate professional review. Some jurisdictions do not permit certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, SOFTWARE GRID LLC and its members, officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, business opportunities, or replacement-service costs.
To the maximum extent permitted by law, the total aggregate liability of SOFTWARE GRID LLC arising from or relating to the Service or these Terms will not exceed the greater of USD 100 or the amount you paid to SOFTWARE GRID LLC for the Service during the 12 months immediately before the event giving rise to the claim.
These limitations apply regardless of legal theory and even if a party was advised that damage was possible. They do not exclude liability that cannot legally be limited, including liability for fraud, willful misconduct, or other non-waivable rights where applicable.
Changes to the Service or Terms
We may update the Service and these Terms to reflect product, legal, security, or business changes. Updated Terms will be posted with a new effective date. Where required by law, we will provide additional notice before a material change takes effect.
Your continued use after updated Terms take effect means you accept them. If you do not agree, stop using the Service and cancel any active subscription before its next renewal. Changes do not retroactively remove rights that applicable law does not allow you to waive.
Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in the state courts located in California, or a federal court with jurisdiction in California, and each party consents to those courts.
Mandatory consumer-protection laws in your place of residence remain applicable where they cannot lawfully be waived. Before filing a claim, contact support@wan3.video so the parties can attempt to resolve the issue informally.
General
These Terms and the Privacy Policy are the entire agreement regarding the Service. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. Section titles are provided only for convenience.
